The Artropolis can in no way be held responsible for damage or loss of the uploaded files or to non-delivery of any product due to incorrect information given or failure by the couriers to locate and deliver the product to you. The Artropolis is not responsible for 3rd party shipping errors, omissions or damaged shipments.

The Artropolis takes no responsibility for the colour of images on your screen compared to how they print or the colour of fashion designs on screen to the final production. For photographic images, each printer is calibrated according to the substrate used and each substrate reacts differently so there could be colour discrepancies.

You, the customer shall indemnify The Artropolis against any claims, costs and expenses arising out of infringement of copyright, trademark, patent or design. The Artropolis gives no warranty, express or implied, concerning the suitability of the goods supplied for any purpose whatsoever nor shall The Artropolis be liable for any direct, indirect, consequential or other loss including loss to third parties arising out of errors in carrying out an order placed or by delay in delivery, or by the suitability of goods for use as intended.

You may only use this site to browse the content, make legitimate purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. In so far as you have registered for The Artropolis Newsletter, The Artropolis creates and processes your personal data exclusively for the dispatch of the newsletter concerned. Your data will be deleted immediately when you terminate the newsletter subscription concerned. You can at any time cancel your subscription via the link contained in the newsletter.

11. Product availability

Lead time is dependent on stock availability and the amount of orders in production at the time of placing your order. Normal turnaround time is around 7 – 10 business days and framing between 10 – 12 business days. (Excluding shipping).

Peak season turnaround time may be longer.

Every effort is made to effect shipment of your order timeously however unforeseen circumstances may cause delays. Should we be faced with such an occurrence The Artropolis will contact you via email and provide you with a revised delivery date.

12. Delivery Policy

When you click to make a purchase with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms & conditions. You must not make any purchase or transfer unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase. If you have any queries please contact us before making any purchase for any service on this website.

13. Delivery of Products and Delivery Time

All products will be delivered to the delivery address supplied by you at the time of placing your order. Production and delivery take 14 – 20 business days after the order and the payment of the order has been received. Time for delivery is an only an estimate and not a condition of this agreement. Delays in the delivery time can under no circumstances be used to cancel an order or to claim any compensation

Any order is subject to cancellation or variation by reason of Force Majeure from any cause whatsoever beyond The Artropolis’s control including inter alia: inability to secure labour, materials, power or supplies, or by reason of an Act of God, war, civil disturbance, riot, state of emergency, strikes, lockout or other labour disputes, fire, flood, drought or legislation.

14. Shipping

We charge a flat rate per delivery to major South African cities. Outlying areas will have an additional delivery fee. International deliveries will be charged at an additional rate.

Please ensure the correct shipping address is provided from the outset when placing your order as title and risk will pass to you once the order has left our premises. Occasionally packages are returned to us undeliverable. Should this event take place every attempt will be made to contact you to make arrangements for re-shipment.

15. Guarantee and Refunds / Returns Policy

The Artropolis provides a 100% guarantee against manufacturing defects. The Artropolis will not cancel or refund an order except in the case of workmanship defect, or if the product arrives damaged or the product does not match the item(s) you ordered.

The Artropolis reserves the right to change brands or substitute the materials used in the production of your order. Materials used in the production of your order are subject to change without prior notice. The next best alternative will be sourced and used in the case of material shortage so that the same quality standards can be maintained.

In order to make a complaint about products from The Artropolis a written complaint must be received by The Artropolis within seven days of receipt of your product. The defective product must be returned (at the customer’s own expense) within 14 days of receipt of the product to be considered viable for a refund.

We will assess the condition of the item(s), and at our sole discretion to either repair or replace the product(s) that does not meet the warranty or condition.

The Artropolis is not responsible for customer generated mistakes, errors or defects including spelling, typographical or grammar errors, order quantity or other ordering errors. Please be sure to preview your order carefully before placing your order.

*In order to request to return a purchase, The Artropolis must be contacted on 073 183 3227 or email info@theartropolis.co.za.

* Note: The Artropolis recommends that you use DHL Express for all returns as it offers shipment tracking through a website tracking system. Should you choose to use a carrier that does not offer a tracking facility and the goods are lost then no refund or return will be considered.

Payment Options and Pricing

All transactions will be processed in South African Rands (ZAR).

The Artropolis endeavours to offer you competitive prices on products; you’re total order price will include the price of the purchase plus any applicable shipping charges and packaging costs.

The Artropolis reserves the right to change pricing at any time without prior notice.

Should The Artropolis reduce it’s price on any shipped products within 10 working days of shipment, you may contact us and request a refund of the difference between the price you were charged and the reduced selling price. To receive the refund you must contact us within 14 days of shipment.

EFT (Electronic Fund Transfer)

We accept EFT payments. One of the most widely used ways of sending money online. You will then have to load The Artropolis as a beneficiary on your internet banking and use the unique order number in the reference line on your invoice for your payment. This should ensure speedy processing and delivery of your selected products.

Direct Deposit

You may pay for your products through a direct deposit. It’s exactly the same as doing an EFT payment, except you’ll have to go into your bank and physically make your direct deposit there. Please email through your deposit slip to us at info@theartropolis to ensure your payment is confirmed and order shipped as quickly as possible.

Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

Law

The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

I understand that all the designs and trademarks are registered to The Artropolis Pty Limited and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by The Artropolis Pty Limited for any civil action or any legal action deemed necessary against me.
